The first movie came out, there was a lot of interest and people who liked it. Then over time, when it came out on DVD, there was people who really have no interest in 'that type of movie' who watched it and realized it was well done, had a story, wasn't just special effects, that the characters weren't flimsy but were developed and had more to them than just being a hero. That is why when the second Spiderman came out, the numbers were through the roof. That and it looked really good. You actually hurt yourself with the end of Spiderman 2, which is why Spidey 3 didn't open as well (you lost that core audience who didn't want the spidey reveal so to speak). Now then with Batman, the first movie was great, extremely interesting and well acted. You had people who liked it when they watched it on DVD, so the audience has increased, you gave a good tease at the end of the first movie, and then you had your villan be played by someone unexpected, then that person died. It's set up for a huge opening and early reviews are that it matches the first or exceeds it.

Absolutely agree for the most part, though if your taking about Spiderman 3 not opening well...do you mean at the Box Office? It broke the opening weekend record, then fell flat after that because it just wasn't a good movie. It made $151M opening weekend.
As of right now, the biggest problem I see with TDK is too many different trailers(5), TV Spots(10?), clips(12) have been released, stay away from these if you can. Go in knowing the least about it as possible, just watch Begins. While the internet has really helped the hype for TDK, its hurting the movie going experience for the fans IMO. Not really spoilers in the trailers, but you can draw a lot of conclusions from watching them. Spiderman 3 made the same mistake by releasing too much footage, and even though that wasn't a strong movie like I think TDK will be, it still takes away from the element of surprise which would add a lot to any movie. If your surprised the first time you see it and you thought it was good, more than likely you will venture back to see it again.
I honestly don't think Heath's death helps or hurts this thing. In the beginning TDK did get extra hype, so awareness levels are very high. Though for non fans I don't think it makes a difference to get them to the theater. I've actually heard more people say they won't go see it because of Ledger's death, than will. The fans however, will see it regardless.
